US Senators propose ridiculous regulations on pornsites

This is utterly insane.
Say hello to having to give the government your ID to post that hentai picture, and also to having to prove that that anime girl consented.

• Requiring platforms hosting pornography to, within two weeks of enactment:
- Require any user uploading a video to the platform to verify their identity
- Require any user uploading a video to the platform also upload a signed consent form from every individual appearing in the video
• Creating a private right of action against an uploader who uploads a pornographic image without the consent of an individual featured in the image
• Requiring platforms hosting pornography to include a notice or banner on the website instructing how an individual can request removal of a video if an individual has not consented to it being uploaded on the platform
• Prohibiting video downloads from these platforms, to be in place within three months of enactment of the legislation
• Requiring platforms hosting pornography to offer a 24-hour hotline staffed by the platform, for individuals who contact the hotline to request removal of a video that has been distributed without their consent
- Requiring removal of flagged videos within two hours of such a request
• Requiring platforms to use software to block a video from being re-uploaded after its removal, which must be in place within six months of enactment of the legislations
• Directing the Federal Trade Commission to enforce violations of these requirements
• Creating a database of individuals who have indicated they do not consent, which must be checked before new content can be uploaded to platforms
- Instructing the Department of Justice to promulgate rules on where this database should be housed, and determine how to connect victims with services, to include counseling and casework
- Establishing that failure to comply with this requirement will result in a civil penalty to the platform, with proceeds going towards victim services

 

While I agree with a few of the milder thrusts, on the whole it’s completely bonkers.

On the other hand, at least you don’t live in India where the government routinely blocks porn sites despite it bing declared unconstitutional. I’m pretty sure someone brought it to court too.

I really don't understand why governments don't learn that bans don't work. The prohibition is still within living memory for the US of A, right? (I checked before posting: technically yes, but actually no).

 

Citation needed that this applies for drawings or animaton, as the intent is clearly to prevent the nonconsensual uploading of IRL porn.

visual depiction, including any photograph, film, video, picture, or computer or computer-generated Image or picture, whether made or produced by electronic, mechanical, or other means, of sexually explicit conduct."

From then on it says anyone who uploads a pornographic image must follow all those rules.

 

Like I expected, it's not deliberate sabotage (in the case of illustrated or written porn), but it's legislators drafting laws without thinking through how the will be applied or even how consistent it is within itself. It's nothing new, even if this one is particularly egregious.

 

Is there anything in the law about what happens when someone falsely accuses them of posting without consent?
Or heaven forbid, lies about being the subject depicted? After all, if you've only got 3 hours to take it down, what if you can't reach them in time?

No, this strikes me as something sponsored by the porn producers trying to limit people posting their stuff for free (or on other pay-sites). Basically forcing you to join them if you want their content. Kind of like Disney plus. Next thing will be the mandate to remove old DVDs from the shelves of adult stores.

 

Serious question: What’s the status of this proposed law? Because if there’s anything I learned from 2017, it’s that proposing a law is basically legislator for shuffling papers around to look busy until it goes further.

To be fair they could be talking about deep fakes.

Also the first part of the bill mentions consent.

You can’t consent with cartoon characters, so this is obviously talking about real life porn.

I honestly think we’ll be fine. There’s always been bills like this before.

 

Alternatively, because cartoon characters cannot consent, the law will be interpreted to mean that cartoon porn is illegal, full stop, and then we will have to wait for a case to wind its way through the courts to find out if that interpretation of the law will be upheld.
